General Terms and Conditions
Services
a. The coach provides personal services to both businesses and private individuals. These services are set out in a proposal and approved by both client and contractor. The coach acts with integrity in accordance with the NFG Code of Conduct, and the client’s interest is central.
b. The nature of the service is explanatory and focused on personal awareness and change. The client decides whether and how to apply this awareness and change in their personal situation. This change is captured through a coaching question and included in the proposal.
c. For both information exchange and personal services, it is assumed that the client is physically and mentally healthy, possibly with temporary issues or a physical complaint, or a need for support in personal development, and has affinity with the coach’s philosophy. It is also assumed that the client has no physical or psychological barriers to participation. If there is any doubt as to whether these conditions are met, the client is responsible for consulting a qualified professional to determine whether participation and use of the coach’s services is appropriate. The client is also expected to inform the coach in advance of any doubts and to report any concerns that arise during the coaching process immediately.
d. The coach reserves the right to refuse to enter into a service relationship with a client. It may also be decided during the course of services that referral or termination of the coaching relationship is more appropriate. However, any issues arising are generally considered an integral part of the process and are addressed as such.
e. The coach supports clients to the best of her ability in gaining greater insight into their competencies and personal functioning. The coach commits to making every effort within the framework of the business philosophy. The client is at all times responsible for providing accurate and complete information about themselves and their physical and mental condition, for making responsible choices, and for implementing them.
f. Any referrals or recommendations made by the coach regarding other professionals, companies, doctors, or information sources are based on knowledge available at that time. Any engagement with such third parties, including services, purchases, or advice, and any consequences thereof, are entirely at the client’s own risk and outside the coach’s responsibility. The coach expects the client to use reasonable judgment in assessing suitability, reliability, qualifications, and conditions.
g. Current prices are agreed upon in mutual consultation. Agreed prices for long-term business engagements remain valid until the end of the calendar year following signature of the agreement, unless otherwise stated, and may be revised thereafter. Any changes will be communicated in a timely manner. Government-imposed charges or taxes apply from the moment they come into effect and do not constitute grounds for termination of the agreement.
h. Appointments may be rescheduled or canceled free of charge up to 48 hours before the session. Appointments are binding once confirmed by both coach and client. Appointments not cancelled or rescheduled at least 48 hours in advance will be charged in full, except in cases of emergency.
If the coach must travel for an appointment, travel expenses (including mileage allowance) remain payable even if the appointment cannot take place due to force majeure while the coach is already on location.
j. Termination of engagement. For open-ended coaching trajectories, the notice period is one session, which will serve as the final evaluation and wrap-up session. For fixed-term trajectories, early termination will result in a refund of remaining sessions, minus one session (1 hour) for administrative costs.
Confidentiality
a. Personal data, including name, address, and contact details of clients, are used by the coach for administrative purposes and to enable communication. Client data are not shared with third parties, including employers. Essential Living operates in accordance with the NFG Code of Conduct, which requires this confidentiality.
b. Due to the typically short-term nature of the coaching relationship, no extensive case files are maintained. Any personal records are accessible only to the coach and the relevant client, regardless of who pays for the services. Access may also take place during a personal meeting between coach and client.
c. Experiences gained during coaching sessions may be used in professional discussions or publications with colleagues, provided that it is not reasonably possible to identify the client concerned. Clients may object in writing within one month of entering into the agreement and/or immediately after becoming aware of such publication.
d. This coach does not report on clients to external bodies such as the UWV, occupational health services or company doctors, or insurance companies, even if explicitly requested by the client.
Payment and donations
a. Prices and payment terms are communicated in advance. The client pays a fee per session or per programme. Payment is due immediately after the session (via payment request or cash), or within 14 days of the invoice date, unless otherwise agreed. Donations without a specific service in return are welcome but cannot retrospectively be considered payment for services rendered.
b. If payment is not received within 14 days, the client is in default. The coach may charge 1% interest per month without further notice. After 14 days, a payment reminder may be sent, for which €10 administration costs may be charged. If payment is not received within 7 days after the reminder, the coach is entitled to initiate collection procedures. All collection costs are borne by the client, provided this is done in good faith and in a reasonable and fair manner.
The coach and client should do their utmost to minimize the negative impact of non-payment on the coaching process.
Guarantee
a. Due to the nature of coaching and the client’s active role in awareness and change, the coach does not guarantee results or improvements. The client determines whether and how quickly change takes place. Based on experience, insight into natural processes, and the client’s personality, interim indications of expected development may be given.
b. If the client is not satisfied with the services provided, this must be reported to the coach in writing within eight days after the session. Consultation will then take place to determine how reasonable satisfaction can be achieved.
Liability
a. In the event of gross negligence by the coach, liability is limited to the coverage provided by the coach’s professional insurance, up to the amount paid out by the insurer. If the insurer does not cover the damage, liability is limited to the amount invoiced for the relevant assignment. The coach is not liable for direct or indirect consequences of normal, incorrect, or improper use of services or information provided. The coach is also not liable for consequential damages. In all other cases, liability is limited to the amount of the relevant assignment.
b. These terms and conditions are governed by Dutch law.
